Terms & Conditions for Open Week 2025 - Join or Refer for the Chance to Win Competition

The following Terms & Conditions apply to the Open Week 2025 - Join or Refer for the Chance to Win an Everest Base Camp Adventure Competition:

  1. The Promoter of this competition in Australia is UBX Australia Pty Ltd (ABN 33 169 373 371) of 6/2 Baroona Rd, Brisbane QLD 4064, Australia and in the rest of the world is UBX International Limited (RCN 12473991) of 3rd Floor 207 Regent Street, London W1B 3HH, United Kingdom.
  2. The competition commences on March 3rd 2025 at 01:00 (AEST) and concludes on April 13th 2025 at 23:59 (AEST). Initial entry submissions timed after 23:59 (AEST) on April 13th 2025 will be excluded from the competition.
  3. The open week commences on Monday, March 24th 2025 at 01:00 (AEST) and concludes on Sunday, March 30th 2025 at 23:59 (AEST).
  4. Entry is open to UBX members in Australia, New Zealand, Singapore, United Kingdom, Republic of Ireland and Japan and must be or become a paying member of a UBX gym throughout the competition period. Employees of the Promoters, franchisees and employees of franchisees and their immediate families are not eligible to enter.
  5. Due to local regulations, participants from the United Arab Emirates (UAE) and the USA are not eligible to enter or receive prizes in this Promotion
  6. Participants must be at least 18 years of age to enter.
  7. UBX reserves the right to disqualify or remove any participant from the Promotion if (a) they are found to have engaged in excessive or unauthorised communications, such as mass messaging or repeated unsolicited contact, or any other behaviour that violates these Terms or undermines the spirit of the Promotion or (b) participation in this Promotion would result in a breach of any local laws or regulations applicable to the Promoter or participant.
  8. The total prize is valued at AUD$10,066, comprised of 2 prizes valued at AUD$5,033 each.
  9. There will be a total of two (2) winners worldwide of the Major prize.
    • 1 x winner will be a new member that joins during the competition period, and
    • 1 x winner will be an existing member who refers someone who joins during the competition period.

      • Each Major prize consists of:

      • A "Climbing Mountains" adventure: Everest Base Camp guided trek (valued at $2,983 AUD)
      • A Travel voucher (valued at $2,000 AUD)
      • A limited edition UBX x Climbing Mountains T-shirt (valued at $50 AUD)
      • All values are exclusive of any applicable value added or good and sales taxes.

      No GST or VAT is payable by participants to the Promoter(s) for such prizes. Participants are solely responsible for any personal tax liabilities (including GST and VAT or income tax if applicable) arising from receipt of such prizes.

  10. The new member mechanic conditions;

    • Eligibility: Must not have been a member of the same UBX gym within the 30 days prior to joining during the competition period.
    • Submission: After joining, new members will receive an email (on or about Monday, April 14, 2025) with a link to submit a short statement (25 words or fewer) about why they love working out at UBX.

      • These short statement submissions must be received by Wednesday, April 30, 2025.

    • Judging: The winners will be chosen by the Promoters based on a strict rubric, measuring creativity, originality, and relevance to the UBX brand. The decision of the Promoters is final and conclusive.
    • Membership Requirement: Entrants must remain an active UBX member at the time of submission.

    The referral entry mechanic conditions;

    • Points System: Existing members earn 1 point for each referred individual who joins on a minimum 28 day membership during the Competition Period (defined above).
    • Winner Determination: The member with the highest total points at the close of the Competition Period wins.
    • Tiebreaker: If two or more members are tied on points, the winner is the member whose first successful referral occurred earliest (based on date/time of membership records).
    • Tracking: All referrals must be registered through Gym Master or the UBX Members App to qualify.
  11. Winners are determined on Thursday May 1st, 2025 AEST. Winners (and franchisees of winners) will be contacted via phone/email on or about this date.
  12. Winners will be announced on Friday May 2nd, 2025 via email and social media.
  13. If you do not want your surname and country included on the list of winners referred to above, please email support@ubxtraining.com prior to the closing date of the promotion.
  14. No part of the prize is exchangeable, redeemable for cash or any other prize, or transferable. If the winner does not participate in the stipulated trek, the travel voucher portion of the prize will be forfeited.
  15. The winner must confirm their availability to complete the trek on the predetermined dates by June 1st, 2025 or the prize is forfeited and may (at the sole discretion of the Promoter) be awarded to the next in place.

  16. By accepting the prize, the winner agrees to the terms and conditions set forth by "Climbing Mountains" for the prize and understands there will be costs incurred and exclusions applicable to the trek. The winner will also be required to bring their own equipment for the trek. Further detail on the exclusions and required equipment can be found at:

  17. The winner may be asked to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize. This includes the use of the photos and information provided as part of their competition entry.
  18. The winner may be asked to permit their image and/or voice, as recorded, photographed or filmed during the winner's participation in the prize to appear in connection with UBX Training or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  19. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  20. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  21. The winner selection will take place at UBX HQ 6/2 Baroona Rd Milton QLD 4000, Australia and the winner will be notified by phone within 7 Australian business days if not earlier as part of the announcement set out in paragraph 12.
  22. The prize will be awarded to the person named in the entry.
  23. Should an entrant's contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
  24. The Promoter's decision is final, and the Promoter will not enter into correspondence regarding the competition result.
  25. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  26. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  27. The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  28. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  29. The collection and disclosure of personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy statement found here: UBX Training | Legal (the Promoter's Privacy Policy).
  30. Entrants consent to the Promoter using the personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding the prize, including to third parties involved in the promotion and any relevant authorities. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter including third parties may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity and research purposes, including sending electronic messages or telephoning the entrant. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter. Any request to update, modify or delete the entrant's details should be directed to the Promoter.
  31. The laws of Brisbane, Australia apply to these terms and conditions, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.
