Terms & Conditions for “UBX Partner Programmes”

  • Capitalised terms in Green are to be found on the webpage which directed you to this page (the Referral Page).

  • To be eligible for the Promotion Benefits, you must:

    • be a Specified Person at the time you sign up for membership (the Sign-Up Time). The Promotion Benefits will cease to be available when you are no longer a Specified Person;
    • not be an existing UBX members at the Sign Up Time; and
    • be eligible to sign up to the participating gym in accordance with, and comply on an ongoing basis with, the Membership T&Cs as defined below. This includes complying with the gym’s rules and policies at all times.
  • The Promotion Benefits are not available in conjunction with any other offer, promotion or discount made available by UBX Australia Pty Ltd (ACN 169 373 371) or any of its affiliates or franchisees (collectively, UBX).
  • Free gifts and inclusions forming part or all of the Promotion Benefits cannot be exchanged for monetary value or otherwise. In the event that, for any reason, whatsoever a Specified Person does not take an element of the Promotion Benefits at the time stipulated then that element of the Promotion Benefits will be forfeited by the Specified Person and cash will not be awarded in lieu of that element of the Promotion Benefits.
  • The Promotion Benefits are only available to Specified Persons employed in each Specified Territory and only available in-gym at gyms located in each Specified Territory.
  • Each of the Promotion Benefits are limited to one per Specified Person. For the avoidance of doubt, each Specified Person may receive a Promotion Benefit (including a discounted membership) at only one of the UBX gyms at any one time. The Promotion Benefits cannot be transferred between UBX clubs.

  • To participate in this offer, a Specified Person will need to sign up with the relevant UBX gym in the Specified Territory directly on site at the gym or via the link provided by that gym (the Sign Up Process) and provide their personal data to that gym. Personal data belonging to such persons will be held and used for the purposes of this offer by such Gym and UBX in accordance with their privacy policy which adheres to the Privacy Act 1988 (Cth) and Australian Privacy Principles (which can be found on their website) (the Privacy Policy).

    • The membership terms and conditions (the Membership T&Cs) will be provided as part of such Sign Up Process.
    • By taking part in the promotion, each Specified Person consents to UBX using the personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion, including to third parties involved in the promotion and any relevant authorities. In addition to any use that may be outlined in the Privacy Policy, UBX including third parties may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity and research purposes, including sending electronic messages or telephoning such Specified Person. If such Specified Person no longer consent to their details being used for future marketing purposes, the Specified Person should contact UBX using the contact information provided in the Referral Page. Any request to update, modify or delete the Specified Person's details should be directed to UBX using such contact information.
  • By accepting the Promotion Benefits, the Specified Person agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the Promotion Benefits, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the Promotion Benefits. This includes the use of the photos and information provided as part of their participation in the Promotion Benefits. The Specified Person agrees that he/she/they will not be entitled to any fee for such use.
  • UBX is not liable to any person in any way (including but not limited to for any indirect or consequential loss) or for any personal injury suffered or sustained in relation to this promotion and offer, except any liability that cannot be excluded by law. UBX is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  • UBX reserves the right in its sole discretion to disqualify any individual who UBX has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. UBX’s legal rights to recover damages or other compensation from such an offender are reserved.
  • The UBX and its associated agencies and employees assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  • If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of UBX, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, UBX reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  • UBX reserves the right to amend or withdraw this offer at any time.
